Kesavananda Bharati, a petitioner in a case that led to the Supreme Court evolving the celebrated doctrine of basic structure of the constitution, died on Sunday.
The case in which Bharati had challenged a Kerala Land Reform Act nearly four decades ago set the principle that the Supreme Court is the guardian of the basic structure of the constitution. In other words, the court ruled that Parliament can amend any part of the Constitution, but such amendment cannot in any manner deface or distort the basic features of the constitution such as democracy, federalism, supremacy of the Constitution, secularism, and separation of powers between legislature, executive and judiciary.
